Purchases, product support, and use of our online store.

Please read before placing your order
Read these Terms together with the Return Policy, Privacy Policy, Shipping & Payment Information, and any product-specific terms provided before purchase. Nothing here takes away a right or remedy that applicable law does not allow you to waive.
30-day returns: For purchases made on or after October 15, 2026, our standard return policy applies a 5% restocking fee to all products, including Zoom Multiple Microphones Kits, calculated on the returned merchandise price after discounts, excluding tax and shipping. Request an RMA through Contact Us within 30 calendar days after delivery. Customers pay return shipping. Legally required rights and more favorable written promises for earlier purchases remain protected. See Section 08 and the Return Policy for details.
These Terms & Conditions ("Terms") govern purchases and related services offered through Martel's online store, including martelelectronics.com and any Martel-operated storefront displaying these Terms, by Martel Electronics Sales, Inc., doing business as Martel Electronics ("Martel," "we," "us," or "our"). "You" means the purchaser or other person who agrees to these Terms.
When you affirmatively accept these Terms at checkout or otherwise validly agree to them, they form part of your agreement with Martel. Please read them before ordering and retain a copy. Merely visiting the website is not, by itself, acceptance of these purchase terms.
To place an order yourself, you must be at least 18 years old and legally able to enter into the transaction. If you purchase for a business, school, government agency, or other organization, you represent that you have authority to act for that organization.
Our Return Policy, Shipping & Payment Information, and the product-specific warranty, support, and service terms disclosed before purchase also apply to the extent they form part of your agreement. Please review those documents together with these Terms.
A specific product guarantee or service commitment made as part of your purchase is not overridden by an inconsistent general provision here. An individually negotiated written agreement controls the subjects it expressly addresses, subject to applicable law.
The version agreed to for your purchase governs that transaction. We will not retroactively impose a new return restriction, shorten an existing warranty or support commitment, or add an unauthorized charge. Our Privacy Policy separately explains our information practices; accepting these Terms does not waive your privacy rights.
Please review the product description, included components, specifications, compatibility information, and any disclosed requirements before purchasing. Photos may show accessories or other equipment not included in the sale. The listing identifies the included items; contact us if a description or photograph is unclear.
Compatibility representations apply to the products, versions, and configurations identified in the offer. Later third-party updates may affect compatibility, but do not eliminate any express promise or applicable warranty.
We may update listings and correct errors for future purchases. A correction does not authorize a higher price or a materially different substitution for an accepted order without your agreement. Equipment recommendations and school-oriented packages do not guarantee admission, graduation, certification, employment, or approval by a court or educational program.
Occasional mistakes: We use reasonable care to provide accurate information, but inadvertent typographical, clerical, data-entry, pricing, or other errors and omissions may occur. These may concern product descriptions, specifications, images, included components, promotions, availability, or shipping estimates. We do not promise that every part of the website will be free of inadvertent errors; the protections and limitations below apply.
Corrections before acceptance: We may correct inadvertent errors and update information after discovery. To the extent permitted by applicable law, an erroneous listing does not, by itself, require Martel to sell a product at a mistaken price or on mistaken terms. Before an order is accepted under Section 04, we may decline an order materially affected by an error where the law permits. Any corrected offer will be presented for your approval before we proceed.
Orders already accepted: Correcting a website listing does not automatically change or cancel an accepted order. If a material error is discovered after acceptance, we may request your agreement to a correction or seek cancellation or rescission only on grounds available under applicable law. We will not increase the agreed price or substitute materially different merchandise without your express agreement. We retain any defenses and remedies for a genuine mistake that applicable law provides.
Notice and refunds: We will notify you promptly when a discovered error materially affects your order. If an order or part of an order is canceled because of our error, we will promptly refund all amounts collected for the canceled portion, including its applicable taxes and associated shipping charges, within the applicable legal deadline. No restocking or cancellation fee will apply to that cancellation. If merchandise has already been delivered, any agreed or legally permitted rescission will include return instructions and restoration of payments and property as required by law. A refund does not eliminate any additional remedy required by law.
Limits of this clause: This clause does not excuse false or misleading advertising, fraud, willful misconduct, gross negligence, or other violations of law. It does not waive enforceable product descriptions, express or applicable implied warranties, required shipping-time obligations, statutory pricing protections, or other rights that cannot lawfully be limited. It cannot be used to retroactively shorten a warranty or avoid a legally required refund. If you notice a possible error, please contact law@marteldigital.com.
Submitting an order is an offer to purchase the selected goods or services. Unless it expressly states otherwise, an automated order-received message acknowledges receipt rather than separately confirming acceptance. Acceptance occurs when we expressly accept the order, ship the goods, deliver the digital product, begin an agreed service, or otherwise accept under applicable law.
Before acceptance, we may decline an order for a legitimate reason, including unavailable inventory, an unverifiable payment, suspected fraud, an unsupported destination, or a material listing error. If we cannot fulfill an order as submitted, we will explain the issue and seek your agreement to a change or cancel the affected portion and provide any required refund.
Please provide accurate order information and report errors or duplicate orders promptly. These acceptance provisions do not postpone any legally required shipping, cancellation, or refund deadline.
Unless expressly stated otherwise, prices are in U.S. dollars. Mandatory fees will be included in advertised prices where required by law. Applicable government-imposed taxes and permitted shipping charges are disclosed before you submit your order. Optional products and services are charged only when selected or otherwise authorized.
Prices may change for future orders. A later change does not alter an accepted order's agreed price. Discounts, coupons, promotional gifts, and financing offers are subject to their disclosed expiration dates, eligibility requirements, quantity limits, and other conditions.
Taxes are calculated according to applicable law and the information provided for the transaction. A valid exemption or resale certificate may be needed for an exemption. The absence of a tax charge does not necessarily remove a purchaser's separate tax obligations. Martel does not provide tax advice or guarantee a deduction or tax benefit.
Available payment methods appear at checkout. By completing payment, you authorize the agreed amount shown for your order. A payment authorization, financing approval, or temporary account hold does not establish that goods have shipped or services are complete.
Payment and financing providers may require separate agreements. Approval, interest, installments, repayment schedules, and financing eligibility are governed by the terms presented by the provider. Financing is not guaranteed. A return or cancellation may take time to appear in the financing account; any refund must be handled under the applicable agreement and law.
A one-time purchase does not authorize recurring charges. If a subscription or automatic renewal is offered, its price, frequency, renewal terms, and cancellation method must be separately disclosed and the required consent obtained before enrollment. Applicable cancellation rights and required notices are not replaced by these Terms.
Do not send full card numbers, card security codes, or account passwords through ordinary email or support forms. Use the designated secure payment process.
Delivery methods, charges, restrictions, and shipping representations are disclosed with the offer, at checkout, or in an accepted quotation. Shipment dates and carrier delivery dates are different. An estimated date does not remove a legal obligation or an express delivery guarantee.
For covered merchandise orders, we will ship within the represented time or, if none is stated, within the applicable legal period, ordinarily 30 days after receipt of a properly completed order. If shipment will be delayed, we will provide the required notice and cancellation or consent options. Where the law requires cancellation, we will cancel the affected order and promptly refund the required amount without a restocking or cancellation fee.
Free-shipping offers apply only under their disclosed conditions. Please provide an accurate, deliverable address. Report missing, damaged, or incorrect shipments promptly and retain packaging when reasonably possible. This request does not shorten statutory deadlines or eliminate remedies for defective goods or nondelivery.
For purchases made on or after October 15, 2026, our standard Return Policy applies to all products. A discretionary return is a return permitted by our policy, such as a change-of-mind return, rather than a remedy required by law. The policy below does not limit rights required by applicable law or retroactively reduce a more favorable written return or guarantee promise that applied to an earlier purchase.
5% restocking fee on all products
Our standard return policy applies a 5% restocking fee to all products, including Zoom Multiple Microphones Kits. The fee is calculated on the returned merchandise price after discounts, excluding sales tax and shipping charges, and is deducted from the merchandise refund. It applies regardless of payment method, subject to the protected rights and earlier-purchase terms below.
Protected rights and earlier purchases: The fee will not be deducted from a refund that applicable law requires us to provide in full, including a qualifying cancellation of an unshipped order under applicable shipping-delay rules. Neither the fee nor a discretionary-return restriction limits nonwaivable rights concerning defective, damaged, misdescribed, incorrect, or undelivered merchandise. Legally required return-shipping remedies remain available. This updated policy does not retroactively reduce a more favorable written return or guarantee promise that applied when an earlier purchase was made.
Request an RMA within 30 days: Complete our Contact Us form and select Repair / RMA. Submit your request within 30 calendar days after your order is delivered. Include your order number, the item or items you want to return, and the reason for the return. If an item is defective, damaged, incorrect, or not delivered, describe the problem so we can determine the appropriate remedy.
Wait for Martel to provide your RMA and return instructions before shipping merchandise back. The 30-day deadline is for submitting the RMA request; the returned package does not have to arrive within that same 30-day period. Pack the item securely and follow the shipping instructions provided with your authorization. Return procedures do not eliminate rights provided by law.
Return shipping: You are responsible for paying the cost of shipping the return back to Martel. Martel does not pay or reimburse return shipping under this standard return policy. Legally required return-shipping remedies remain available. These Terms do not authorize an undisclosed deduction or the withholding of a legally required refund.
Contact us promptly to request cancellation. After shipment or commencement of an authorized service, available options depend on the applicable terms and your legal rights. The restocking provision does not, by itself, create a separate order-cancellation fee.
Refund processing: For an authorized return accepted under this policy, Martel will inspect the returned item and issue the approved refund, less the applicable 5% restocking fee, within seven calendar days after receiving the return. Refunds are issued to the original payment method, unless another lawful method is required or agreed upon. Any shorter applicable legal deadline remains in effect. Any required adjustment to sales tax will be handled according to applicable law. Your bank or payment provider may need additional time to post the credit after Martel issues it. Nothing here restricts good-faith billing disputes or other payment rights.
Warranty coverage varies by product and may be provided by Martel, the manufacturer, or another identified service provider. The warranty and enforceable promises made with your purchase determine the coverage, duration, service procedures, and available remedies. Please retain those documents and your purchase records.
Written warranty terms applicable to warranted consumer products must be available for review before purchase where required by law. Contact us if you need help obtaining or understanding the applicable warranty. A warranty advertised for one product does not automatically apply to all products.
Elite Court Reporter Laptop: The Elite Court Reporter Laptop includes a 3-Year Onsite Warranty. The applicable written warranty identifies the provider, coverage, commencement date, service arrangements, and conditions. Life-of-the-Laptop Technical Support is a separate benefit and does not, by itself, extend the hardware warranty. These Terms do not shorten any longer warranty expressly promised with an earlier or individually agreed purchase, or any extension required by law.
If onsite service is included with another product, its arrangements are governed by that purchase's warranty. Technical support and hardware warranty coverage are separate benefits unless the offer states otherwise.
These Terms do not disclaim or shorten an express warranty, an applicable implied warranty, or a nonwaivable consumer protection. Referring a customer to a manufacturer does not remove an independent obligation that Martel has under the purchase agreement or applicable law.
Support is provided according to the benefits included with the purchased product or separately purchased service. When a laptop is sold with Life-of-the-Laptop Support, that commitment applies to the covered laptop and the customers entitled to that benefit under the offer at purchase. These Terms do not shorten that commitment.
Life-of-the-Laptop Support is technical support, not a promise of free lifetime hardware replacement, replacement computers, paid third-party licenses, or new software versions unless expressly included in the offer.
Support may require your cooperation, access to the affected equipment, valid software licenses, an internet connection, or assistance from the software publisher. Remote access requires your permission. Separately chargeable services outside your included support require your agreement before the charge is incurred.
You and any applicable third-party rights holders retain your respective rights in files, recordings, dictionaries, transcripts, and other content supplied for service. A support request does not transfer ownership to Martel or authorize advertising use of confidential material. You authorize access reasonably necessary to perform the service you request, subject to applicable privacy law and agreed confidentiality obligations.
Maintain a current backup before repairs, troubleshooting, operating-system changes, or file transfers. Preserve original recordings or evidence that must remain unchanged. After a transfer, confirm that the required files and settings work before erasing or disposing of the original device.
You must own the equipment or be authorized to approve the work. Secure unrelated confidential information and disclose special access or evidence-preservation requirements before service begins. Hardware failure, encryption, damaged storage, missing credentials, or licensing restrictions may limit recovery or transfer. Data recovery is not guaranteed unless expressly agreed. These precautions do not excuse Martel from applicable duties of care.
Software is provided under its applicable license. Buying software or a device does not transfer ownership of the software's underlying intellectual property. Third-party software may require activation, registration, acceptance of the publisher's terms, and compliance with device or transfer limits.
Use, copying, transfer, and distribution must comply with the license and applicable law. These Terms do not restrict rights granted by an applicable open-source license.
The offer identifies included software, subscription periods, recognition credits, updates, and services. Additional charges require disclosure and authorization. Any return restriction for software or digital products must be disclosed before purchase and remains subject to applicable law and any express guarantee.
You are responsible for obtaining required recording permissions and following applicable privacy, recording, evidence-handling, retention, security, and professional rules. Test your complete workflow before an important assignment and use an appropriate independent backup when a lost recording could cause significant harm.
Recognition and transcription results can vary with speakers, training, recording quality, environment, and software configuration. Review generated text against source material before professional reliance.
Unless expressly included in the agreement, a product purchase does not include certification of transcript accuracy, legal admissibility, evidentiary compliance, or compliance with an agency's information-security requirements. This section does not reduce an express performance or compatibility warranty.
Martel and its licensors retain their rights in original website text, photographs, graphics, software, branding, and other protected materials. Third-party marks belong to their respective owners. You may use the website to evaluate products, make authorized purchases, and retain information reasonably needed for your purchase or internal business use.
Do not unlawfully copy or commercially exploit protected content, impersonate another person, use unauthorized payment information, introduce malicious code, bypass security controls, or materially interfere with the website. Links must not falsely suggest our endorsement. These restrictions do not prohibit fair use, truthful commentary, or other activity protected by law.
You may share honest opinions about Martel, our products, and your purchasing or support experience. These Terms do not prohibit truthful negative reviews, impose review-related penalties, or require transfer of ownership of a review.
When you voluntarily submit a review for publication on our website, you retain ownership and grant us a nonexclusive, royalty-free license to display and reproduce it for that purpose. Reasonable formatting must not distort its meaning.
Do not submit private information about others, confidential material, unlawful threats, or content you have no right to publish. We may moderate unlawful, fake, irrelevant, or privacy-invading content using criteria applied without regard to a review's positive or negative sentiment. Disagreement with an opinion is not, by itself, a reason to treat it as false.
Our Privacy Policy explains our handling of personal information and available choices. These Terms are not a substitute for that policy or any required privacy notice.
We may use the contact details you provide for communications reasonably necessary to process your order, arrange delivery, provide requested support, or address an account or security issue. Optional marketing and text-message programs are subject to their own notices, choices, and any legally required consent.
Accepting these Terms is not, by itself, consent to automated marketing calls or text messages or to optional tracking that requires separate consent. Third-party payment services, financing providers, and publishers have their own terms and privacy notices. Their involvement does not eliminate Martel's responsibilities as the seller.
Maintenance, technical problems, transportation disruptions, and other events may affect access or performance. Except for express commitments and legal requirements, we do not promise uninterrupted website access or compatibility of every feature with every device or browser.
This provision does not sell purchased goods "as is," disclaim product warranties, excuse misleading descriptions, or eliminate obligations for accepted orders. An event outside our reasonable control does not remove any mandatory delay notice, cancellation, refund, or other remedy.
Nothing in these Terms excludes liability for fraud, willful misconduct, gross negligence, injury to a person, or a violation of law where liability cannot lawfully be excluded or limited.
These Terms do not impose a blanket purchase-price cap on liability. Liability and available remedies are determined by the applicable agreement and law. Any limitation in a separately agreed commercial contract is subject to that law and cannot remove a nonwaivable protection.
No provision here eliminates a required refund, repair, replacement, warranty remedy, or other statutory right. Consumer protections that cannot be waived remain in effect even when another provision uses general limiting language.
Please contact us about an order or service concern, with your order number and a description, so we have an opportunity to help. Contacting us is not a prerequisite to exercising a statutory right, making an appropriate complaint, or meeting a legal deadline.
California law and applicable federal law govern these Terms, except that this choice does not deprive a consumer of mandatory protections that otherwise apply. A dispute may be brought in a court with jurisdiction and venue permitted by applicable law, including an eligible small-claims court.
These Terms do not impose mandatory arbitration, waive participation in a class action, shorten statutory claim periods, or waive a remedy that cannot legally be waived. Any separately negotiated commercial agreement remains subject to applicable law.
Written quotations, purchase orders, credit terms, and institutional purchasing arrangements require acceptance by an authorized Martel representative. A separately accepted written agreement may establish different delivery, invoicing, warranty, or service terms. Mandatory procurement requirements remain applicable.
Sending a purchase order does not, by itself, establish credit terms, guarantee inventory, or confirm a requested deadline. References to a school, court, agency, or software brand do not by themselves establish sponsorship, affiliation, or endorsement.
We may revise these Terms for future transactions by publishing an updated version and date, with additional notice or renewed consent where required. Revisions do not retroactively alter accepted orders, existing disputes, or previously purchased warranty or support commitments.
We may restrict website or account access when reasonably necessary to address fraud, unlawful activity, security threats, or material misuse. Such action does not automatically cancel an accepted order, eliminate an existing warranty, or authorize withholding a legally required refund.
An unenforceable provision will not be enforced; the remaining provisions continue to the extent permitted by law. Not enforcing a provision on one occasion does not automatically waive it later. A written exception for one customer or order does not automatically change the terms of every other purchase.
